 Your Website Could Be a Legal Ticking Time Bomb — Here's How to Fix It

In the last few months alone, three members of our community have faced lawsuits over website compliance. Three. And these aren't big corporations, these are store owners just like you and me.

That's exactly why I sat down with my favorite lawyer (yes, I really do have a favorite lawyer)  Tannia Ospina. Tannia is a longtime Inner Circle member, a business law and intellectual property attorney, and she has also been an e-commerce store owner since 2014. She built her brand Bell Threads completely from scratch, which means she doesn't just understand the law, she understands us. She knows what our days look like, she knows we don't have endless cash to throw at problems, and she speaks in plain English, not legal speak. I love that about her.

Here's what came out of our conversation, and I really want you to pay attention to this.

 

The risk is real, and it's coming for small stores first

I think most of us assume that lawsuits and compliance issues are problems for big corporations, not for someone running a Shopify store from their home office. But here's what Tannia told me, and it stopped me in my tracks: small and newer Shopify stores are actually the first ones being targeted. Why? Because people who are looking for these gaps know exactly where to find them. They know that a newer store owner probably hasn't gotten to all of this yet, because we are busy. We're making products, running ads, writing emails, packing orders…legal compliance is not exactly top of the list.

But here's the reality. 

If someone sues you, you have to respond. And responding to a lawsuit, even if you're in the right, costs money. We're not talking about $500. 

Tannia said we're talking about tens of thousands of dollars. So the question isn't really whether you can afford to get this done, it’s whether you can afford not to.

 

What are people actually getting sued for?

This is where it gets really eye-opening. 

People are getting sued for not having a privacy policy. For not having the right cookie policy. For having a chat bot or contact widget on their website with no disclaimer. 

And that last one hit close to home for me, because Tannia pointed out that the little tool I use on my own website where people can leave me a question (I ask for their email address so I can respond) needed a disclaimer. I pay for that software. They did not provide one. I was on the hook for it and didn't even know.

Here's why: there are privacy laws in different states that require you to get consent from both parties before recording a communication. And an online chat or message exchange can be considered a recording. So you have to disclose that you're keeping a transcript, that the communication will be used for business purposes. It seems obvious, right? But “obvious” doesn't hold up in court.

 

What you actually need on your website

Tannia created a legal compliance bundle specifically for product-based e-commerce store owners, and this is what it covers: terms and conditions, a privacy policy, a disclaimer, disclosures, a website accessibility statement, a copyright notice, a cookie policy, instructions for opting out of data collection, and a chat bot disclaimer if you have one. These are all legally required under U.S. privacy laws and FTC guidelines. And beyond the legal requirement, having these in place minimizes chargebacks, reduces customer disputes, lowers your risk of accessibility lawsuits (which are incredibly common right now) and honestly just makes your store look more professional and trustworthy.

 

Why copy-pasting from Google or AI isn't the answer

I know a lot of us have done this. I was guilty of it way back in the day. You search for a privacy policy template, you find something on another website, you copy and paste it. Or you use AI to generate one. And it feels like the problem is solved. But here's the thing Tannia said that really stuck with me: it's usually what's missing from those templates that gets you into trouble. If you copied from a service business, those templates aren't built for a product-based business. If the website you copied from has basic technology, it won't cover all the tools you're actually using on your store. And privacy laws change constantly — so even if it was accurate when you found it, it may not be accurate now.

 

The lifetime updates piece is a big deal

One of the things I love most about this compliance bundle is that it comes with lifetime updates. Tannia sends them out proactively, you don't have to go hunting for them. Because this is an area that genuinely does not stay still. Laws are pending in different states right now that are going to create more issues for e-commerce store owners. Marketing practices are changing. Platforms are changing. What we were doing in 2014 is completely different from what we're doing today, and our legal policies need to reflect that. As Tannia put it, you are going to have to update these, so you want a system that makes that easy.

 

What if you already have policies on your site?

This is a great question, and Tannia's answer is simple: when did you last update them? Your legal policies have to reflect what your business is currently doing right now — your current products, your current tools, your current marketing practices, your current return policies. 

If you set them up two years ago and haven't touched them since, there's a good chance they're out of date. 

And a policy that doesn't reflect your actual business practices isn't protecting you.

What if you have a brother-in-law who's a lawyer?

I love this question because I think a lot of us have been tempted to go this route. And Tannia's answer is honest and fair: 

Not every lawyer is going to understand online business, e-commerce operations, or the specific compliance issues that come with having an online store. 

If they're not in this world and not watching the lawsuits that are happening right now, they're genuinely not going to know which questions to ask. They won't even know where the gaps are. And if you're asking them to look at it for free, they're definitely not going out of their way to research it for you.

This is as important as setting up your product pages

That's something I said to Tannia during our conversation, and she agreed immediately. We spend so much time and energy getting our products right, getting our website right, running our ads, building our email list. And all of that work is sitting on top of a foundation that could crack if someone decides to target you for missing policies. It doesn't take much. It doesn't take a disgruntled customer with a good case. It just takes someone who knows what to look for.
